Welcome to the MyRedIsland website (the "Site"). Please read the below terms carefully, because your use of the Site constitutes your agreement to these terms. MyRedIsland reserves the right to make changes to the Site and to these Terms of Use from time to time. When we make changes, we will post them here. You may wish to check this section from time to time, because by visiting the Site, you agree to accept any such changes.

Please review our Privacy and Security Policy, which also governs your visit to the Site. To the extent there is a conflict between the terms of the Privacy and Security Policy and the Terms and Conditions, the Terms and Conditions shall govern.

INTELLECTUAL PROPERTY INFRINGEMENT

We rely on a network of independent designers, vendors, affiliates, subsidiaries, agents, third-party product providers, third-party Content providers, suppliers, contractors, distributors, merchants, sponsors, licensors and the like (collectively, "Associates") who supply some of the goods advertised on the Site and, in some cases, drop ship them directly to our customers. In accordance with the Digital Millennium Copyright Act, we are not liable for any infringement of copyrights, trademarks, trade dress or other proprietary or intellectual property rights arising out of Content posted on or transmitted through the Site, or items advertised on the Site, by our Associates. You may not download (other than page caching) or modify the Site or any portion of it without our express, prior written consent. If you use the Site, you are responsible for maintaining the confidentiality of the information you submit through “My Account” and the corresponding password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under “My Account” or password. We reserve the right to refuse service, terminate accounts and to remove or edit content submitted by you in the “My Account” area of the Site.

When you access a non-MyRedIsland website, please realize that it is independent of MyRedIsland. Linking to any off-site pages is at your own risk. MyRedIsland makes no warranties or representations about any non-MyRedIsland website and has no responsibility for such websites or their content. The products on our Site are intended for personal, not commercial or business use, unless otherwise indicated. As such, you assume the risk when purchasing products for a commercial or business use or application.

All Gemstone treatments are disclosed based on the information provided by the designers, vendors and suppliers. If any discrepancies are found and confirmed by an independant certified Appraiser/Gemologist, it is the responsibility of consumer/customer to notify MyRedIsland within 30 days of purchase with copies of such appraisals. Some high valued items may be subject to a shorter return policy, such as 7 days or 14 days.

ONLINE CONDUCT

You agree to use the Site only for lawful purposes. You are prohibited from posting on or transmitting through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racial, ethnic, or otherwise objectionable material of any kind, including but not limited to any material that is or that encourages fraudulent activity or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, federal, or international law. You agree not to post any paid endorsement, unless it is approved in advance by MyRedIsland and your material connection to the advertising entity is fully disclosed. If we are notified of or suspect allegedly infringing, defamatory, damaging, illegal, or offensive Content provided by you (e.g., through an author chat or online review), we may (but without any obligation) investigate the allegation and determine in our sole discretion whether to remove or request the removal of such Content from the Site. We may disclose any Content or electronic communication of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Site; or (iii) to protect the rights or property of MyRedIsland.com, its Associates, our users and customers and/or you.

We reserve the right to prohibit conduct, communication, or Content that we deem in our sole discretion to be unlawful or harmful to you, the Site, Site users, our customers or any rights of MyRedIsland.com or any third party. Notwithstanding the foregoing, neither MyRedIsland.com nor its Associates can ensure prompt removal of questionable Content after online posting. TERMINATION OF USAGE

We may terminate your access or suspend your right to access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law, is in breach of these Terms and Conditions or is harmful to the interests of other users, Associates, or us. In addition, we reserve the right to refuse an order from any customer in our sole discretion.

USAGE BY MINORS

This Site is not intended for or directed to persons who are minors (typically persons under the age of 18, depending on where you live). Because we cannot prohibit minors from accessing, viewing, browsing, visiting or using the Site, we must rely on parents, guardians and those responsible for supervising minors to decide which materials are appropriate for minors to view and/or purchase. By registering with this Site, purchasing products from us or providing us with any information, you represent to us that you are legally permitted to enter into a binding contract (18 years of age or older in most jurisdictions) or, if you are under the legal age of consent, you have the express permission from your parent or guardian and that any information you provide to us is not inaccurate, deceptive or misleading.

APPLICABLE LAW

If you access the Site from anywhere in the United States or Canada, you agree that the laws of the State of Ontario, Canada without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and MyRedIsland.com and/or its Associates.

SITE POLICIES, MODIFICATION AND SEVERABILITY

Please review our other policies, such as our Privacy and Security Policy, Returns Policy, Shipping & Delivery Policy and others, all of which are incorporated herein by this reference and are posted on the Site and may be accessed by using the Search Help function on this page. These policies also govern your visit to the Site. We reserve the right to make changes to the Site, policies, and these Terms and Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

NOTICE TO CANADIAN RESIDENTS

You are hereby notified that if you are a Canadian resident, sales or use tax in your province is due on purchases made on our Site and that the Province of Ontario requires Canadian purchasers to file a sales or use tax return for items purchased on this Site.

RISK OF LOSS

All items purchased from MyRedIsland.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

MyRedIsland prides itself in providing exclusive, quality merchandise. Availability of merchandise may vary at MyRedIsland.com. Some featured items may be available only in limited quantities or only while supplies last. Once an item is out of stock, we will attempt to remove the item promptly from display on MyRedIsland.com. Display of an item on MyRedIsland.com is not a guarantee that the item is currently in stock or that it will be available on our website when you visit again. MyRedIsland will make every reasonable effort to display its merchandise on MyRedIsland.com as accurately as possible. Unfortunately, various factors, including the display and color capabilities of your computer monitor, may significantly affect what you actually see on your screen. MyRedIsland is not responsible for the display of any color, size, texture or detail of its merchandise on your computer screen and cannot guarantee the accuracy thereof. However, if you are dissatisfied with any item you purchase from MyRedIsland.com, you can return or exchange it to us. For more information regarding MyRedIsland's return and exchange policy and procedures, please visit the Site's Customer Service page on our website, and then click on the "Returns & Exchanges" section. As each product photograph is taken individually, products have not been sized relative to each other.

Prices displayed on MyRedIsland.com are quoted in U.S. currency and are valid and effective only in the United States. Prices are subject to change at any time. When a Currency Converter is used, the exchange rate used to convert US$ is at the discretion of MyRedIsland.com. MyRedIsland.com reserves the right to change such exchange rates without prior notice.

INFORMATION ACCURACY

MyRedIsland will use reasonable efforts to include accurate and current information on the Site, but there may be occasions when information on the Site contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability and other matters. MISCELLANEOUS

This Agreement shall be governed by, construed and enforced in accordance with the laws of the Ontario, Canada, without giving effect to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by an appropriate federal or provincial court sitting in the Province of Ontario.

TERMINATION

MyRedIsland may terminate this Agreement and deny you access to the Site at any time, immediately and without notice, if in MyRedIsland's sole discretion you fail to comply with any term or condition of this Agreement.

CONFLICT DIAMONDS

MyRedIsland's diamond supply consists of quality diamonds, sourced from the world's most reputed suppliers. As responsible citizens and jewelry merchants, we share the public's concern regarding conflict diamonds. At MyRedIsland, we only purchase our diamonds through respected, well-established, legal channels.

In April 2003, President Bush passed a bill adopting the Kimberley Process that requires all US diamond retailers to buy diamonds from manufacturers who have documentation warranting that the merchandise was obtained through legitimate channels. Today, the US Customs Service is actively enforcing the Kimberley Process requirements as diamonds enter American ports.

MyRedIsland supports the Kimberley Process. Each diamond cutter we work with obtains diamonds exclusively from legitimate sources, and they comply completely with the Kimberley Process requirements. At MyRedIsland, we will continue to support and promote any process that works to uphold legitimacy in the diamond trade.
